PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APPLICATION
This document constitutes a legally binding agreement between you (referred to as "User," "You," or "Your") and Codebrik Infotech Pvt Ltd (referred to as "Company," "We," "Us," or "Our"), governing the access and use of Sentry, a communication and messaging application ("Application" or "App"). By accessing or using our Application, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms").
1. Agreement to Terms
To accept these Terms, you must have attained the legal age required to enter into a binding contract under applicable Indian law. Your acceptance of these Terms occurs when you click the acceptance button, check the acceptance checkbox, or commence using the Application. If you disagree with any provision of these Terms, you must discontinue use of the Application immediately.
2. Account Registration
Registration for the Application requires providing your active mobile phone number. Should your mobile number change, you may update it through the in-app number change functionality. By registering, you consent to receive verification codes via text messages and phone calls from us or our authorized service providers. During registration, you commit to: (a) furnishing truthful, accurate, current, and complete information; and (b) maintaining and promptly updating your registration details to ensure they remain accurate and complete at all times.
3. Application Features
The Application currently offers the following features exclusively within India: one-to-one voice and video calling; personal messaging between users; and file sharing capabilities including images, videos, and voice recordings. We reserve the right to modify, expand, or restrict these features at our discretion.
4. Modifications and Updates
You acknowledge that Codebrik Infotech Pvt Ltd retains the right to modify the Application, including adding new features or discontinuing existing ones, at any time without prior notice. To ensure optimal functionality and access to enhanced features, you may be required to download and install updates as they become available.
5. Prohibited Activities
In addition to compliance with all other provisions herein, you agree not to: (i) share access to the Application with unauthorized third parties; (ii) develop or offer services based on the Application without express written authorization; (iii) engage in activities that could harm, disable, overload, or impair Application functionality; (iv) violate any applicable local, state, national, or international laws, including Indian laws; (v) transmit content that is unlawful, obscene, defamatory, threatening, harassing, discriminatory, or promotes illegal activities including violent conduct; (vi) attempt to reverse engineer, decompile, disassemble, or extract source code from the Application; (vii) disseminate false information, misrepresentations, or deceptive content; (viii) impersonate other individuals or entities; (ix) engage in automated messaging, bulk communications, or spam distribution; and (x) infringe upon intellectual property rights or other proprietary rights of third parties.
6. Third-Party Integrations
The Application may facilitate access to or interaction with third-party applications, websites, or services ("Third-Party Services"). Your engagement with such Third-Party Services is governed by their respective terms of service and privacy policies. We bear no responsibility for the content, functionality, or practices of these Third-Party Services.
7. User Content
You bear sole responsibility for all content transmitted, uploaded, stored, or shared through the Application, including messages, images, videos, voice recordings, and files ("User Content"). You represent and warrant that you possess all necessary rights to share such User Content and that doing so does not infringe upon third-party rights. Codebrik Infotech Pvt Ltd accepts no liability for any errors, omissions, or damages arising from User Content. By using the Application, you grant Codebrik Infotech Pvt Ltd a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to process and transmit User Content solely for the purpose of providing Application services. You retain complete ownership of your User Content and all associated proprietary rights.
8. Privacy and Data Protection
Your personal information is handled in accordance with our Privacy Policy, which forms an integral part of these Terms. By using the Application, you consent to our data practices as described therein. You are responsible for maintaining the confidentiality of your account credentials and device security. You assume responsibility for all activities occurring under your account. In case of unauthorized access or suspicious activity, immediately notify us at support@sentryme.com. We disclaim liability for losses resulting from unauthorized account access.
9. Indemnification
You agree to defend, indemnify, and hold harmless Codebrik Infotech Pvt Ltd, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from or related to: your violation of these Terms; your infringement of third-party rights; your breach of applicable laws; or any other claim arising from your use of the Application.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CODEBRIK INFOTECH PVT LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APPLICATION, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED INR 5,000 (INDIAN RUPEES FIVE THOUSAND ONLY).
11. Disclaimer of Warranties
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CODEBRIK INFOTECH PVT LTD EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND FREEDOM FROM ERRORS OR VIRUSES. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION. ANY CONTENT DOWNLOADED OR OBTAINED THROUGH THE APPLICATION IS AT YOUR OWN RISK. NO ADVICE OR INFORMATION FROM CODEBRIK INFOTECH PVT LTD SHALL CREATE ANY WARRANTY NOT STATED IN THESE TERMS.
12. Account Suspension and Termination
We reserve the right to suspend or terminate your account, or restrict access to the Application, under the following circumstances: (a) breach of these Terms; (b) requests from law enforcement or governmental authorities; (c) voluntary account deletion request by you; (d) discontinuation or significant modification of the Application; or (e) suspected unlawful activity. To contest any suspension or termination, contact support@sentryme.com within thirty days of notification. Following this period, suspended accounts may be permanently terminated, resulting in deletion of all associated data, including account credentials and stored information.
13. Intellectual Property
Sentry, including its logo, design elements, and associated trademarks, are the exclusive property of Codebrik Infotech Pvt Ltd. Unauthorized use, reproduction, or display of these intellectual property assets is strictly prohibited without prior written consent.
14. Dispute Resolution
Any dispute, controversy, or claim arising from or relating to these Terms or the Application shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. Arbitration shall be conducted individually; class arbitration or consolidated proceedings are not permitted. The arbitrator's decision shall be final and binding. Arbitration proceedings shall be held in Ahmedabad, India, and the award may be enforced in any court of competent jurisdiction. Notwithstanding the foregoing, Codebrik Infotech Pvt Ltd may seek injunctive relief in any court of competent jurisdiction.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal proceedings shall be subject to the exclusive jurisdiction of courts in Ahmedabad, India.
16. Amendments to Terms
We may revise these Terms at any time by posting updated Terms within the Application or by notifying you via the email address associated with your account. Your continued use of the Application following any modifications constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically for updates.
17. Severability
If any provision of these Terms is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to render it enforceable, or severed if modification is not possible, while the remaining provisions continue in full force and effect.
